contract

This is the contract we require each owner to sign, once a potential buyer is accepted we can email the contract to you. The contract must be emailed back and we will sign and send a hard copy with your puppy and also through email.

1)       

The BUYER agrees to provide a life-long commitment, comfortable environment, prompt medical attention, proper grooming and responsible care. This includes keeping this puppy/dog parasite free and up to date with inoculations, proper nutrition, which consists of a good quality professional feed given at regular intervals, and fresh water available at all times. The BUYER promises
to provide a safe environment for the dog, and never allow the dog to roam freely without proper fencing or supervision. The BREEDER has had the puppy/dog microchipped in order to facilitate his/her return if lost or stolen.

2)                      

The BREEDER guarantees this puppy/dog to be of sound health and is free of life-threatening diseases or disabilities at the time of this sale. A health record of all shots and wormings will be provided by the BREEDER.  The BUYER agrees to take this dog to a licensed veterinarian of his choice within 72 hours for a physical examination.  Should life threatening diseases or disabilities be discovered by BUYER within 72 hours after receipt of puppy, and attested to in writing to BREEDER by BUYER’S licensed veterinarian within 72 hours, BREEDER will provide BUYER with a replacement puppy as soon as such puppy is available to BREEDER. BUYER must pay for any shipping or miscellaneous charges associated with transport of the of the replacement puppy. NOTE: All puppies shipped have the chance of being exposed to other dogs while in transport, this is out of breeder’s control.  The BREEDER will assume no responsibility if this puppy/dog is given Ivermectin, Immodium, Valbazen or any of the sensitive drugs and suffers an adverse reaction. This guarantee does not cover any health issues caused by neglect or injury from the BUYER. This guarantee does not include minor illnesses and health issues such as colds, allergies, internal or external parasites or umbilical hernias. However, the BREEDER will disclose any known illnesses or health issues prior to the sale. The BREEDER assumes NO liability for any injury to said puppy during transport or delivery.

3)     

Should PUPPY upon delivery and up to PUPPY is TWO (@) years of age be diagnosed with life inhibiting genetic defects confirmed by two unassociated veterinarians, one (1) to be of BUYERS choosing (1) to be of BREEDERS choosing, thereby causing puppy to be unsuitable as a working/pet the BUYER and BREEDER agree upon provision of veterinary reports and, where applicable, the BREEDER will provide BUYER with one of the following options. NOTE: ALL veterinarian costs and testing procedural expenses are BUYER’S responsibility.

a.       Should BUYER choose to keep pupy, BREEDER will refund 50% of the price that was originally paid for puppy. With the submission the BREEDER of the supporting veterinary reports required above. 50% refund does not apply to any testing, veterinary bills, shipping or travel costs, which the BUYER might incur. BUYER understands that in choosing this option that any and all further guarantees of puppy’s two (2) year and health guarantee are null and void.

b.       Should BUYER choose to relinquish ownership of pupy to BREEDER, BREEDER will provide a replacement puppy to the BUYER as soon as such a puppy is available to the BREEDER. BUYER must pay for any shipping or miscellaneous charges associated with transport of the replacement puppy. BREEDER will re-home puppy. If it is determined that puppy cannot function in society as a companion pet/working dog due to temperament or genetically derived medical disorders then the puppy will be euthanized at the BREEDERS expense. c.) Please note dental and allergy issues are not life inhibiting issues and therefore are not covered under the two year health guarantee. 3. BREEDER shall not be held responsible for the development of faults, diseases, or disorders, which are due to BUYERS negligence and environmental factors

4)     

BREEDER shall not be held responsible for acts of puppy, which are due to BUYERS negligence or lack of proper training and socialization of puppy.

5)     

Should puppy exhibit aggressive behavior that BUYER deems intolerable and irreversible WITHIN 12 months after purchase, BUYER will provide BREEDER with proof that puppy has been sufficiently socialized and that obedience classes and other structured training methods have been attempted with no results. Upon receipts of such proof, evaluations of puppy will be scheduled with at least two recognized breeders or trainers, one to be chosen by BUYER, one to be chosen by BREEDER, Inititals ____/_____. Should puppy be deemed overly aggressive by the two chosen breeders/trainers, BREEDER will arrange for euthanasia of puppy and provide BUYER with a replacement puppy as soon as such a puppy is available to BREEDER. BUYER must pay for any shipping or miscellaneous charges associated with transport of the replacement puppy.

6)    

The BREEDER assumes no responsibility for training difficulties or behavior problems. BUYER will receive an informational packet on how to train their new puppy. If BUYER follows the recommendations given in the packet, the BUYER should not have any problems with the training process. The BREEDER does not guarantee size. We will give the BUYER the weight of the puppy’s parents and the weight of other puppies out of that mating. We can give the BUYER an educated guess as to full grown weight, but there are too many variables besides genetics.

7)                          

If at any time the BUYER can no longer retain possession of this dog, the BREEDER is to be notified and given first option of resuming full ownership of dog in order for the BREEDER to locate this dog a new home.  Refunds, if any, will be at the discretion of the BREEDER. The dog will be returned with all medical records. Should any circumstances arise that affect the quality of life of this dog, the BREEDER is to be informed so that they may participate in determining the future of the dog.  The BREEDER reserves the right to approve/prohibit any transfer of this animal to a third party. Under no circumstances will this dog be sold, leased, traded or given away to any pet shop, research laboratory, animal shelter or similar facility.

8)                  

The BUYER agrees to contact the BREEDER immediately if any questions or concerns arise about the dog, such as housing, diet, health or training. The BUYER agrees to keep the BREEDER informed of any treatment as it occurs. This provides the BREEDER with an opportunity to follow up on puppies and gives us important feedback and information on the health or our dogs for future generations. The BREEDER gives a two-year guarantee against any congenital defects of the puppy. If this should occur then the puppy will be returned to the BREEDER, and the BUYER will receive another puppy of the same quality or better when there is one available.

9)                          

It is understood at the time of sale that this is a breeding quality dog and it is representative of its breed. It is structurally and temperamentally suited as a breeding and/or working dog. The Buyer agrees to register the dog using the kennel name of BTA.  

The preceding paragraphs contain conditions established to ensure the well being of the dog, but also to uphold and maintain the reputation of quality that Black Tie Affair has established over the years. The Buyer’s agreements will continue for the dog’s life and the Seller will have the right to enforce the agreements.

 

Breeder neither makes nor implies any warranties or guarantees, express or implied, other than those written in the agreement including without limitation, the warranties of merchantability and fitness. This document constitutes the entire agreement between the BREEDER and BUYER with respect to this sale. This contract must be signed, witnessed and post dated to Black Tie Affair within 7 days upon receipt of puppy or all guarantees and this contract will be null and void. (Please make a copy of this contract for your records and return original). The BUYER’S signature below indicates that He/She has read, agrees and does understand all the conditions of the Sales Agreement and Contract of Sale. Any disputes, mediation, or legal proceedings will be held in the State of Washington in Pierce County.
